API Terms of Service (ToS)
§ 1 Subject Matter and Scope
- The Provider provides an Application Programming Interface (API) for querying data from the ICD-10-GM (International Statistical Classification of Diseases and Related Health Problems, German Modification).
- The service is provided for a technical service fee. This fee is charged explicitly for the technical infrastructure and data preparation, not for the acquisition of copyright to the official data itself.
§ 2 Copyright and Usage Rights
- The ICD-10-GM is an 'other official work' within the meaning of § 5 Para. 2 of the German Copyright Act (UrhG).
- The user is granted usage rights under the condition that the prohibition of alteration (§ 62 UrhG) and the requirement of source attribution (§ 63 UrhG) are strictly observed.
- Alteration of codes, terms, texts, or usage instructions is prohibited.
- According to WHO guidelines, the works may not contain commercial advertising. Only promotional references to one's own publications are permitted.
§ 3 Prohibition of Raw Data Redistribution
- Redistribution of the data in its original format (as raw data, text files, or complete database dumps) to third parties is prohibited.
- The API delivers transformed JSON responses. Only these processed data may be further processed within software applications.
§ 4 Attribution Requirement
The user is obliged to include the source attributions listed in the appendix of these terms in full when passing on or displaying the data to third parties.

§ 5 Limitation of Liability of the Provider
- The Provider assumes no liability for the correctness, completeness, or topicality of the provided classification data.
- Liability for damages caused by the use of incorrect or incomplete information is excluded, unless there is demonstrable intentional or grossly negligent behavior on the part of the Provider.
§ 6 Liability of the Publisher (BfArM)
- BfArM is liable for damages only insofar as it is guilty of intent or gross negligence.
- BfArM is not liable for damages to third parties caused by the passing on of incorrect information.
- The user indemnifies the Provider and BfArM against all claims by third parties arising from a violation of usage rights or incorrect passing on by the user.
